1. Acceptance of Terms

By accessing or using Didiye ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App. These Terms apply to all users, including free and premium subscribers.

2. Description of Service

Didiye is an AI-powered nutrition companion app that provides:

• AI-based meal analysis using Google Gemini technology
• Nutrition tracking and analytics
• Social community features for health-conscious users
• Goal setting and progress tracking
• Meal planning and dietary recommendations
• Integration with health platforms (Apple Health, Google Fit)

The App is provided "as is" and may be modified, updated, or discontinued at any time.

3. Eligibility

You must be at least 13 years old to use Didiye. Users under 18 must have parental or guardian consent. By using the App, you represent that you meet these age requirements.

4. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Not share your account with others

5. Subscription and Payments

Free Plan

Didiye offers a Free Forever plan with basic features including unlimited AI meal scanning, basic nutrition tracking, and community access.

Premium Subscriptions

• Premium Plan: $9.99/month with advanced features
• Family Plan: $19.99/month for up to 5 family members
• Subscriptions automatically renew unless canceled
• Prices are subject to change with 30 days notice
• Payment is charged to your App Store or Google Play account

Free Trial

New users receive a 14-day free trial of Premium. You can cancel anytime during the trial without charge. If not canceled, you will be charged when the trial ends.

Cancellation and Refunds

• Cancel subscriptions through your App Store or Google Play account
• Cancellations take effect at the end of the current billing period
• Refunds are available within 14 days of purchase if not satisfied
• Contact support@didiye.com for refund requests

6. User Content and Conduct

Content You Provide

You retain ownership of content you submit (meal photos, posts, comments). By sharing content, you grant Didiye a license to use, display, and process this content to provide our services.

Prohibited Conduct

You agree NOT to:

• Post offensive, harmful, or inappropriate content
• Harass, bully, or threaten other users
• Share false or misleading nutrition information
• Promote eating disorders or unhealthy behaviors
• Violate any laws or regulations
• Attempt to hack or disrupt the App
• Create multiple accounts to abuse free trials
• Scrape or copy content without permission
• Impersonate others or misrepresent affiliation

Content Moderation

We reserve the right to remove content and suspend accounts that violate these Terms. Users can report inappropriate content through the app.

7. Health and Medical Disclaimer

• Always consult with a qualified healthcare provider before making dietary changes
• Do not disregard professional medical advice based on app recommendations
• AI meal analysis may contain errors or inaccuracies
• Users with medical conditions should seek professional guidance
• In case of emergency, contact emergency services immediately

8. Accuracy of Information

While we strive for accuracy, nutrition data from AI analysis may not be 100% precise. Factors affecting accuracy include:

• Photo quality and lighting
• Food preparation methods
• Portion size estimation
• Recipe variations and ingredients

Users should verify critical nutrition information and can manually adjust entries as needed.

9. Intellectual Property

All rights, title, and interest in Didiye (including software, design, trademarks, and content) are owned by Didiye or our licensors. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the software
• Use Didiye trademarks without permission
• Create derivative works based on the App

10. Third-Party Services

Didiye integrates with third-party services (Google Gemini AI, Apple Health, Google Fit, payment processors). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party service failures or policies.

11. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data. By using Didiye, you consent to our data practices as described in the Privacy Policy.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Didiye is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the past 12 months
• We are not liable for health outcomes or decisions based on app recommendations

13. Indemnification

You agree to indemnify and hold Didiye harmless from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the App
• Content you post or share
• Your violation of any rights of others

14. Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in prohibited conduct
• Fail to pay subscription fees
• Engage in fraudulent activity

You may delete your account at any time through app settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

15. Dispute Resolution

Informal Resolution

Before filing a legal claim, please contact support@didiye.com to resolve disputes informally.

Arbitration

Any disputes will be resolved through binding arbitration rather than in court, except where prohibited by law. You waive your right to a jury trial and class action lawsuits.

Governing Law

These Terms are governed by the laws of the jurisdiction where Didiye is registered, without regard to conflict of law provisions.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance of the updated Terms. The "Last Updated" date will be revised accordingly.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
